Jeremiah Reynolds Discusses Right of Publicity After Sarver v. Chartier at Los Angeles Copyright Society

On June 13, 2016, KWIKA partner Jeremiah Reynolds, along with David Halberstadter of Katten Muchin Rosenman LLP and Academy Award winning screenwriter and producer Mark Boal, discussed the landmark ruling in Sarver v. Chartier and the future of right of publicity law. They also addressed the often-asserted claim of “defamation by fiction,” the creative process of transforming interviews of real people into fictional works, First Amendment protections for motion pictures and television productions, and where the decision leaves the use of celebrity images in video games and California’s “transformative” use test.
