Sony facing potential liability on multiple fronts for major hack

KWIKA founding partner Greg Aldisert was quoted by Variety in Ted Johnson’s piece on the recent massive breach of Sony Pictures Entertainment’s confidential data.  “It is a huge problem on so many fronts, from employees to talent to business partners to shareholders,” said Greg.

A major factor in determining liability will be whether the studio exercised “reasonable care” in protecting its data.  “These are basically negligence questions,” Greg continued.  “It is really hard to say without expert testimony about what is reasonable or what is enough protection.  Given the sophisticated nature of the hacking, it may be harder to say they didn’t use ordinary care.”
